These Conditions of Sale provide the user, as well as the potential customer, with all the useful information so that his purchase on www.clubfive.it is correct and protected.

The "Clubfive.it" site, including its mobile version, is owned and managed by Goyatè Sas di Ciro Nocerino, registered with the Naples Business Register, REA Napoli 934394, VAT number and tax code 08129701218, with registered office legal in Napoli - viale Antonio Gramsci 13 – 80121, tel +39 0823513486, email info@clubfive.it (hereinafter Club Five ).

The following conditions of sale comply with Legislative Decree 6 September 2005, n. 206, including subsequent amendments and additions. The user, by purchasing on our site, will fully accept the provisions of these conditions and the provisions of the privacy policy .

The terms and conditions may undergo periodic changes, therefore we advise the user to print and keep a copy of the terms applied at the time of purchase.

Furthermore, the customer declares to have full capacity to act and to enter into a contract (for example, a minor will need a guardian). Goyatè is not required in any case to verify the ability to act of visitors and buyers, and is not responsible if an action contrary to what is written in these purchase conditions is carried out.

Furthermore, the customer declares that the purchase of the products on the site are for personal and non-commercial purposes.

 

1. PERSONAL ACCOUNT

To proceed with a purchase on the site, we advise the user to create a personal account (the user can also place an order as a guest) in order to have better performing services at his disposal. Once an account has been created, the user is required to maintain the confidentiality of his login information and assumes full responsibility for any action performed through his account.

 

2. PRODUCTS

Before placing an order, the customer can select one or more products from the various categories available on Clubfive.it.

If a product in which the user is interested becomes unavailable during the check-out phase, the order will be blocked and the user will be informed of the reason.

In rare cases computer problems could occur, therefore it may happen that an unavailable product is still purchasable. In these circumstances we will refund the price of the item and send the remainder of the order. Where the user is not interested in receiving the order in part, he can take advantage of the right of withdrawal as provided for in Article 9 of this document.

All our articles comply with the regulations in force in Italy and the user must use the products according to their intended use.

Club Five is free to change the assortment of products, prices, descriptions and availability at any time and without notice.

 

2.1 VIEWING ITEMS

Club Five strives to ensure that the colors of the product images are as faithful as possible, but due to various factors (for example different types of screens), these may not be accurate.

If the user's expectations are not met, the latter may take advantage of the right of withdrawal as provided for in Article 9 of this document.

 

3. PLACE AN ORDER

When a user wants to buy on our site, he simply has to add one or more items to the cart and proceed with checkout.

During this phase it is necessary:

  • Having accepted the terms and conditions of sale, the general conditions of use and the privacy policy of Club Five.
  • Provide all the information necessary for payment and shipment to be successful.

The user will have the opportunity to review his order, read the various conditions of sale, check the price and characteristics of the product and communicate any errors, only before confirming the order.

If the customer notices any errors only after having completed the purchase, he will be able to take advantage of the right of withdrawal as provided for in article 9 of this document.

Club Five reserves the right not to process an order if you notice problems during the order processing phase. In the event of cancellation of the order, Club Five will notify the customer via email.

The sale will be concluded only when the customer is confirmed that the order has been delivered to the courier.

 

4. EVASION

Once the check-out has been completed, Club Five will send the customer an email containing the summary of the order. This email does not in any way constitute a purchase confirmation. In fact, the sale will be considered concluded only when the user receives a shipment confirmation email.

The Club Five team will work to ensure that order preparation times are as short as possible, trying, even in the busiest periods, to entrust orders to the courier within 24 hours of receiving them.

 

5. PRICES

The prices indicated on our site are indicated in Euros and are inclusive of VAT (shipping costs included).

Club Five may change the prices of the products both due to changes in the VAT rate and for company choices at any time and without notice.

 

5.1 SHIPPING COSTS

The price of the product does not include any shipping costs, which will be calculated only during the order summary phase, before completing the check-out.

The customer can consult any shipping costs by reading the information relating to shipments.

Shipping costs may be changed at any time and for any reason by Club Five.

 

6. PAYMENT

The customer guarantees to Club Five that he is authorized to use the payment method chosen during check-out. Any bank charges are charged to the customer.

In case of non-payment, Club Five will cancel the order and notify the customer via email.

Club Five accepts among the payment methods:

  • Credit/debit cards, Visa or Mastercard;
  • PayPal;
  • Online coupons.

 

7. DELIVERY

Orders placed by the customer will be shipped to the address entered during checkout by GLS express courier.

GLS makes deliveries within 24/48h (48/72h for Calabria, Sicily and Sardinia) from Monday to Friday, from 9:00 to 18:00, with the exception of public holidays (delivery times start from receipt of the confirmation email shipping).

Upon delivery, GLS will sign an electronic receipt which will serve as proof of delivery.

If the customer is absent at the time of delivery, he will receive a notice of attempted delivery with which he can contact GLS to organize a new delivery. In the event that GLS is not contacted, it will independently arrange for another delivery to be made in the following days.

Where, even in the second attempt, the customer will be absent, the courier will leave a notice containing the address of the nearest GLS depot, where the package can be collected within and no later than 10 days. At the end of this period, the package will return to our logistics center and the customer will be refunded the value of the order less shipping costs, storage costs and any other additional costs.

Any delays in shipping are not dependent on Club Five.

 

8. DEFECTS AND/OR DAMAGES TO THE PRODUCTS

8.1 PACKAGING DEFECTS AND DAMAGES UPON DELIVERY

At the time of delivery, the customer must check whether the order wrapping is intact, and, if he notices any damage, he must:

  • Notify the courier immediately before signing for the delivery.
  • Notify Club Five of the incident by sending an email to shop@clubfive.it

If the customer fails to comply with these points, he may not be entitled to a refund of the order and/or the return of the ordered items.

 

8.2 DEFECTS AND DAMAGES OF THE PRODUCTS

If the customer notices any damage or defects to the product during the 2-year warranty, he can inform us of the incident by sending an email to shop@Clubfive.it specifying the nature of the defect and attaching clear photographic documentation.

Once it has been recognized that the defect or damage is not of an accidental nature, the exchange of the same item will be sent at the expense of Club Five, with collection of the defective piece. If only 14 days have passed since receipt of the order, the defective or damaged piece must be packed and returned to the courier together with all its accessories.

 

9. WITHDRAWAL

For each order, the customer will have 14 days from receipt of the latter to withdraw from the purchase.

In order to exercise the right of withdrawal, the customer is requested to write an email to shop@Clubfive.it and follow the instructions of our team.

The return will always be borne by the buyer, who can freely decide whether to rely on GLS, or whether to choose another one.

To receive a refund of the item (shipping costs excluded), the latter must not be worn, therefore Club Five reserves the right to view the returned item before proceeding with the credit.

The parcel containing the item to be returned must be sent to Goyatè sas, Il tarì, area asi sud, mod 232, 81025 Marcianise (CE).

10. LIABILITY

These terms and conditions of sale set out all of Club Five's obligations and responsibilities regarding the sale of products.

Club Five will not be liable where:

  • The customer uses the product in a way that does not comply with the provisions.
  • Damages and losses are caused to the customer due to a non-execution of the order.
  • Any inaccuracies contained in the texts communicated by third parties are reported.
  • Illegal acts are committed on the payment methods communicated by the customer.
  • You experience problems with the courier.
  • By using the site, the customer suffers damages, whether they are foreseeable or not.
  • The customer provides incorrect or false data.

If Club Five is held liable for damage limited to an order, it will only refund the amount paid by the customer.

 

11. CUSTOMER'S OBLIGATIONS

The customer undertakes to:

  • pay the price of the products purchased in the manner and within the timescales established by the conditions of sale.
  • Print the following conditions of sale after completing the purchase.
  • Insert the data correctly and not to make false statements.
  • Keep your account information confidential.

 

12. GENERAL TERMS

The terms and conditions of sale are constantly updated, therefore it may happen that following a legislative change one or more points may be invalidated. If this happens, the Terms and Conditions of Sale will always be valid, with the exception of invalidated points. Club Five undertakes to ensure that the points data is updated as soon as possible.
